These Terms & Conditions govern the use of the Louise Gleam Beauty website and purchases made through our online store.

Please read these Terms carefully before placing an order. By placing an order through our website, you agree to these Terms & Conditions together with the policies referred to in them.

Nothing in these Terms limits or excludes any mandatory consumer rights available under applicable European Union, Portuguese or other applicable consumer protection law.

Louise Gleam Beauty is the seller responsible for the contract with the customer, regardless of whether an order is prepared, fulfilled or shipped by a third-party supplier or logistics partner.

2. Scope of These Terms

These Terms apply to consumers who purchase products through the Louise Gleam Beauty online store.

Additional policies forming part of the purchasing conditions include:

  • Privacy Policy
  • Cookie Policy

Where there is a conflict between these Terms and a mandatory provision of consumer law, the mandatory legal provision will prevail.

3. Our Fulfilment Model

Louise Gleam Beauty may use third-party wholesalers, dropshipping providers and logistics partners within Europe to prepare and dispatch customer orders.

Some products may therefore be shipped directly from a fulfilment partner to the customer's delivery address without first being transported to Louise Gleam Beauty.

Our current fulfilment arrangements may include BTSWholesaler and other logistics or wholesale partners where applicable.

These third parties assist with fulfilment and delivery but are not the seller in the contract between Louise Gleam Beauty and the customer.

Customers should contact Louise Gleam Beauty directly regarding their purchase, delivery, returns, refunds or product-related issues.

4. Products

We aim to provide accurate and up-to-date information about the products available on our website, including descriptions, photographs, sizes, quantities and other relevant characteristics.

Product availability is subject to stock levels within our fulfilment network. Stock information may change rapidly and, in exceptional circumstances, a product may become unavailable after an order has been placed.

If we are unable to fulfil an ordered product, we will notify the customer as soon as reasonably possible.

We will not substitute an unavailable product with a different product without the customer's express agreement.

4.1. Product images and colours

We aim to represent products as accurately as reasonably possible. However, minor differences in colour may occur due to lighting, photography and the settings of the device or screen used to view the website.

Product packaging may occasionally be updated by the manufacturer. Where a packaging change does not materially affect the identity, quantity, quality or characteristics of the product, the product received may have packaging that differs slightly from the photograph displayed on the website.

Material differences between the product ordered and the product delivered remain subject to the customer's statutory conformity rights.

4.2. Cosmetic ingredients and product information

For cosmetic, skincare and personal-care products, manufacturers may occasionally update formulations, packaging or ingredient lists.

Customers should review the information and ingredient list provided on the physical product before use, particularly where they have allergies, sensitivities or specific ingredient requirements.

If you notice a significant discrepancy between the product information displayed on our website and the product received, please contact Louise Gleam Beauty before using the product.

5. Product Availability

Products displayed on the website are offered subject to availability.

Although we use stock information supplied by our fulfilment network, synchronisation delays, simultaneous purchases or inventory adjustments may occasionally result in a product becoming unavailable.

If fulfilment becomes impossible because a product is unavailable, we may cancel the affected item and refund all amounts paid for that item.

Where appropriate, we may offer an alternative product, but no substitution will be made without the customer's agreement.

6. Prices, Taxes and Charges

Prices displayed on Louise Gleam Beauty are stated in euros (€), unless otherwise indicated.

Prices presented to consumers include applicable taxes where required by law. The final amount payable will be displayed before the customer completes the order.

Any applicable shipping charges will also be displayed during checkout before the order is submitted.

Customers will not be required to pay additional shipping or other charges that were not properly disclosed before the purchase.

6.1. Price changes

Louise Gleam Beauty may change product prices at any time for future purchases.

A price change will not affect an order that has already been validly accepted, except where correction is legally permitted due to an obvious and manifest technical or pricing error.

6.2. Obvious pricing errors

We make reasonable efforts to ensure that prices displayed on the website are correct.

If an obvious technical error results in a clearly incorrect price, we may contact the customer before fulfilment to explain the error and, where permitted by applicable law, cancel the affected item and issue a full refund.

This provision is not intended to allow Louise Gleam Beauty to cancel orders because of ordinary price fluctuations or changes occurring after purchase.

7. Placing an Order

Before submitting an order, customers are responsible for reviewing:

  • The selected products
  • Quantities
  • Delivery address
  • Billing information
  • Shipping method
  • Total price

The checkout process will clearly indicate that submitting the order creates an obligation to pay.

After the order has been placed, the customer will receive an electronic confirmation containing relevant information about the purchase.

8. Order Acceptance and Confirmation

Submitting an order constitutes a request to purchase the selected products.

The sales contract is concluded when the order is accepted and confirmed by Louise Gleam Beauty, subject to applicable consumer law.

Customers will receive order confirmation in electronic form.

If an order cannot be accepted or fulfilled, for example because of genuine stock unavailability, payment failure, a manifest technical error or a justified fraud-prevention concern, we will notify the customer and refund any amount that has been charged for products that cannot be supplied.

9. Fraud Prevention and Order Verification

To protect customers and Louise Gleam Beauty against fraudulent transactions, certain orders may be subject to reasonable security or payment verification.

We may temporarily hold order processing while carrying out necessary checks.

Where there are reasonable grounds to suspect fraud, unauthorised payment or unlawful activity, an order may be refused or cancelled subject to applicable law.

Where payment has already been collected for an order that is subsequently cancelled for these reasons, the appropriate refund will be processed unless the payment is lawfully retained or blocked by the relevant payment provider, financial institution or competent authority.

10. Payment

Available payment methods are displayed during checkout.

Payments may be processed using secure third-party payment service providers, including Stripe.

Payment information entered into a payment provider's secure environment is processed according to that provider's security procedures and privacy terms.

Louise Gleam Beauty does not intentionally store complete payment card numbers entered directly into a third-party payment provider's secure system.

11. Shipping and Delivery

Shipping destinations, processing arrangements, delivery estimates, tracking information and shipping charges are described in our Shipping & Delivery Policy.

Certain orders may be prepared and dispatched directly by a third-party fulfilment or logistics provider.

The use of those providers does not transfer Louise Gleam Beauty's statutory obligations to the customer.

Unless a different delivery period has been agreed, applicable consumer law may require delivery without undue delay and generally no later than 30 days after conclusion of the contract.

12. Delivery Addresses

Customers are responsible for providing complete and accurate delivery information.

If an incorrect or incomplete address is provided, customers should contact Louise Gleam Beauty as soon as possible.

We will make reasonable efforts to correct an address before dispatch, but changes cannot be guaranteed once fulfilment has started.

Where reasonable and documented additional costs arise directly because the customer supplied an incorrect or incomplete address, refused delivery without a valid legal reason, or failed to receive or collect the parcel, such additional costs may be charged or deducted where permitted by law.

This does not apply where the delivery problem was caused by Louise Gleam Beauty, a fulfilment partner or the carrier.

13. Risk During Delivery

Louise Gleam Beauty remains responsible for the risk of loss or damage to the goods during transport until the customer, or a third party designated by the customer other than the carrier, receives physical possession of the goods.

Different rules may apply where the customer independently contracts a carrier that was not offered by Louise Gleam Beauty, where permitted by applicable law.

14. Order Cancellation Before Dispatch

Because orders may enter fulfilment quickly after payment confirmation, customers who wish to cancel an order should contact us immediately.

We will make reasonable efforts to cancel an order before dispatch, but cancellation cannot be guaranteed once fulfilment or shipping has begun.

If cancellation before dispatch is no longer technically possible, this does not affect any statutory right of withdrawal that may apply after delivery.

15. Right of Withdrawal, Returns and Refunds

Consumers purchasing online generally have a statutory right to withdraw from the contract within 14 calendar days from receipt of the goods, subject to the exceptions provided by law.

For certain sealed goods that are unsuitable for return for health protection or hygiene reasons, the statutory right of withdrawal may cease once the protective seal has been opened, where the legal requirements for that exception are satisfied.

16. Legal Guarantee of Conformity

The statutory legal guarantee is separate from the 14-day right of withdrawal.

Under Portuguese consumer law, new movable goods are generally covered by a three-year legal guarantee of conformity from delivery.

Consumers in another country may benefit from additional mandatory protection under the laws applicable to them.

Where goods do not conform to the sales contract, the consumer may be entitled, depending on the circumstances and applicable law, to remedies including:

  • Repair
  • Replacement
  • A proportionate price reduction
  • Termination of the contract and refund

17. Promotions and Discount Codes

Promotions, discount codes and special offers may be subject to specific conditions displayed at the time of the promotion.

Unless otherwise stated:

  • Discount codes cannot be exchanged for cash
  • Discounts cannot be applied retrospectively to completed purchases
  • Promotional codes may have an expiry date
  • Certain products or brands may be excluded
  • Multiple promotions may not be combinable

Any material restrictions will be communicated clearly as part of the relevant offer.

18. Customer Accounts

Customers may have the option to create an account on Louise Gleam Beauty.

Customers are responsible for keeping their account credentials confidential and for providing accurate account information.

If you believe that your account has been accessed without authorisation, please contact us promptly.

We may restrict or suspend an account where reasonably necessary to prevent fraud, abuse, security threats or unlawful use of the website.

The Louise Gleam Beauty name, original branding, original website design, original written content and other materials created by Louise Gleam Beauty are protected by applicable intellectual property laws.

Certain product photographs, trademarks, brand names, logos, product descriptions or other materials displayed on the website may belong to manufacturers, suppliers, distributors or other third parties and are used where authorised or otherwise permitted by law.

Third-party trademarks and brand names remain the property of their respective owners.

Nothing on the website grants users permission to reproduce, distribute, modify or commercially exploit protected content without the permission of the relevant rights holder, except where permitted by law.

20. Third-Party Websites and Services

Our website may contain links to websites, social media platforms, payment services or other services operated by third parties.

Louise Gleam Beauty does not control third-party websites and is not responsible for their independent content, availability, privacy practices or terms of use.

This does not affect Louise Gleam Beauty's responsibilities regarding services that we select or use to fulfil our obligations to customers.

21. Website Availability and Technical Errors

We aim to keep the website available, accurate and secure, but uninterrupted access cannot be guaranteed.

The website may occasionally be unavailable due to maintenance, technical issues, security measures or circumstances outside our reasonable control.

We may correct typographical, technical or factual errors on the website when identified.

Corrections made to the website do not retrospectively remove or reduce consumer rights arising from an order already validly concluded.

22. Liability

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

In particular, nothing in these Terms excludes or limits mandatory consumer rights or liability that cannot legally be excluded.

To the extent permitted by law, Louise Gleam Beauty will not be responsible for losses that:

  • Were not caused by a breach of our obligations
  • Were not reasonably foreseeable when the contract was concluded
  • Result from the customer's unlawful or improper use of a product

Products purchased as a consumer are intended for personal use. To the extent permitted by law, Louise Gleam Beauty is not responsible for commercial or business losses arising from a consumer purchase.

23. Events Outside Our Reasonable Control

Certain events outside our reasonable control may temporarily affect processing, transport or delivery.

These may include severe weather, transport disruption, strikes, major infrastructure failures, natural disasters, public authority measures or other exceptional events.

Where such an event occurs, we will make reasonable efforts to minimise the impact and keep affected customers appropriately informed.

This provision does not remove any statutory right the customer may have to cancel an order, terminate a contract or receive a refund where the requirements of applicable law are satisfied.

Personal data is processed in accordance with our Privacy Policy.

25. Changes to These Terms

We may update these Terms & Conditions to reflect changes in our business, services, fulfilment arrangements, website or legal obligations.

Updates apply prospectively from the date on which the revised Terms are published, unless applicable law requires otherwise.

An order already concluded will generally remain governed by the version of the Terms applicable when the order was placed.

26. Governing Law

These Terms & Conditions and contracts concluded through Louise Gleam Beauty are governed by Portuguese law, subject to applicable European Union law.

If you are a consumer habitually resident in another country, this choice of Portuguese law does not deprive you of mandatory consumer protections that apply to you under the law of your country of residence where such protections cannot legally be excluded.

27. Consumer Complaints and Alternative Dispute Resolution

Louise Gleam Beauty provides access to the Portuguese Electronic Complaints Book (Livro de Reclamações Eletrónico) in accordance with applicable Portuguese law.

Access to the official complaints platform should be available through a clearly visible link on our website.

29. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the extent necessary under applicable law.

The remaining provisions will continue to apply where legally possible.
